Terms of Use

This page states the Terms of Use ("Terms") under which you may use the College Essentials website, https://www.mycollegedocs.com (the "Site"). These Terms include the College Essentials Privacy Policy and Disclaimer, incorporated into these Terms by reference.

College Essentials, LLC. ("College Essentials " or "we") provides services ("College Essentials Services") offered through pages on the Site. These Terms constitute a binding agreement between you and College Essentials and are deemed accepted by you each time you use or access the Site. If you do not accept the Terms stated here, do not use the Site.

College Essentials may revise these Terms anytime by posting an updated version to this web page. You should visit this page periodically to review the most current Terms because they are binding on you. If you violate these Terms, you may have your access to and use of the Site suspended or terminated at College Essentials’s sole discretion. College Essentials retains the right to cancel any sale or Site access.

Use of College Essentials Material and College Essentials Services; Grant of License. College Essentials grants you a limited, personal, non-exclusive, non-transferable license to use forms on the Site (the "Forms") for your own personal use. If you are an organization, a purchase allows one individual within your organization to exercise the rights granted by these Terms on an exclusive personal basis. Except as otherwise provided herein, you acknowledge and agree that you have no right to modify, edit, copy, take screen-shots, reproduce, create derivative works of, reverse engineer, alter, enhance, or in any way exploit any of the Forms in any manner, except for modifications in filling out the Forms for your authorized use. To the maximum extent allowable under applicable law, except as explicitly identified in these Terms, you agree not to publish, re-publish, lend, license, give away, look at the software source code, modify the software source code, post to an Internet web site, or use in an automated system any intellectual property, legal materials, documents, web pages, software, products, web links, email, information, or any other materials provided by or previously provided by College Essentials or the Site, including any portion thereof (the “College Essentials Material”) nor will you utilize College Essentials Material in any way for the creation of an automated system or website, nor will you allow or assist a third party to do so. You agree to only use College Essentials Material and the Site as a customer. Subject to these Terms, if you are evaluating the Site strictly as a potential customer, you are granted a license to evaluate the Site for that purpose only.

The license granted is subject to the Terms. It entitles you to (A) use Forms as specified by the Terms only, (B) make electronic copies of each completed Form for your personal use, and (C) make necessary hard copies (e.g., printed or photocopied) of each completed Form for your personal records and as required for addressing the specific circumstances for which the Form is intended. You agree not to use any Form for any purpose against any law in your jurisdiction.

Payment. To access College Essentials Products, you must provide credit card information to College Essentials as required by the Site. College Essentials will charge your credit card by displaying pricing in return for access to the Site and College Essentials Services. Access to use the site will expire within 6 months of purchase

Legal Advice, Information, and Decision Making Responsibility. College Essentials Legal Forms provides state-specific, law firm-quality wills and powers of attorney that are inexpensive, simple to create, and easy to download. We are not a law firm and may not perform services performed by an attorney. Neither we nor our employees are acting as your attorney. Any use of the Site does not create or constitute an attorney-client relationship between you and College Essentials or any employee of or other person associated with College Essentials.

The information contained in the Site is general legal information and should not be construed as legal advice to be applied to any specific factual situation. As the law differs in each legal jurisdiction and may be interpreted or applied differently depending on your location or situation, the information or use of documents on the Site is not a substitute for the advice of a lawyer. Assignment. This agreement cannot be assigned.

Intellectual Property. When accessing or using the College Essentials Site, you agree to obey the law and respect the intellectual property rights of others. Your use of the Site is always governed by and subject to laws regarding copyright, trademark, and other intellectual property ownership. You agree not to upload, download, display, perform, transmit, or otherwise distribute any information or content violating any third party's copyrights, trademarks, or other intellectual property or proprietary rights. You agree to abide by laws regarding copyright ownership and use of intellectual property. You shall be solely responsible for any violations of any relevant laws and for any infringements of third-party rights caused by any content you provide or transmit or that is provided or transmitted using your College Essentials user account. All copyright, trademarks, and other intellectual property rights (registered and unregistered) of College Essentials Material belong to College Essentials. College Essentials reserves all of its rights in the College Essentials Material. Nothing in the Terms grants you a right or license to use any intellectual property rights owned or controlled by College Essentials or any other third party except as expressly provided in these Terms.

NO WARRANTY. THE SITE AND ALL MATERIALS, DOCUMENTS, OR FORMS PROVIDED ON OR THROUGH YOUR SITE USE ARE PROVIDED ON AN "AS IS" AND "AS AVAILABLE" BASIS. TO THE FULLEST EXTENT PERMITTED BY LAW, College Essentials EXPRESSLY DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE AND NON-INFRINGEMENT.

EXCEPT AS PROHIBITED BY LAW, IF THERE IS LIABILITY FOUND ON THE PART OF College Essentials, IT WILL BE LIMITED TO THE AMOUNT PAID FOR THE College Essentials SERVICES, AND UNDER NO CIRCUMSTANCES WILL THERE BE CONSEQUENTIAL OR PUNITIVE DAMAGES. SOME STATES DO NOT ALLOW THE EXCLUSION OR LIMITATION OF PUNITIVE, INCIDENTAL, OR CONSEQUENTIAL DAMAGES, SO THE PRIOR LIMITATION OR EXCLUSION MAY NOT APPLY TO YOU. THIS PARAGRAPH DOES NOT APPLY TO NORTH CAROLINA CONSUMERS.

Arbitration. Any dispute or claim relating to your use of the Site or any products or services sold or distributed by College Essentials or through the Site will be resolved by binding arbitration. You agree to waive all rights to a jury trial.

To begin an arbitration proceeding, you must send a letter requesting arbitration and describing your claim to College Essentials, LLC, Attention: 5203 Juan Tabo Blvd. Suite 2b Albuquerque, New Mexico 8711.1 The American Arbitration Association (AAA) will conduct the arbitration under its rules, including the AAA's Supplementary Procedures for Consumer-Related Disputes. The AAA's rules are available at www.adr.org.

Class Action Waiver. You agree to waive the right to litigate in court or arbitrate any claim or dispute as a class action, either as a class member or a representative. You agree that (i) no arbitration proceeding hereunder, whether a consumer dispute or a business dispute, shall be certified as a class action or proceed as a class action or on a basis involving claims brought in a purported representative capacity on behalf of the general public, other customers or potential customers or persons similarly situated, and (ii) no arbitration proceeding hereunder shall be consolidated with or joined in any way with, any other arbitration proceeding. You further agree to waive the right to participate in a class action lawsuit against College Essentials.

Governing Law. This Agreement shall be governed by and interpreted by the laws of the State of Delaware without regard to conflict of laws principles. The Parties agree that if any suit or proceeding is brought in connection with this Agreement, such suit or proceeding shall be brought in the state or federal courts located in New Castle County, Delaware. The Parties shall submit to the exclusive jurisdiction of such courts and waive any and all jurisdictional, venue, and inconvenient forum objections to such courts.

General. College Essentials makes no claims or representations that the Site may be lawfully viewed or accessed outside the United States. Access to the Site may not be legal by certain persons or countries. Suppose any provision of these Terms is invalid by any competent jurisdiction court. In that case, the invalidity of such provision shall not affect the validity of the remaining provisions of these Terms, which shall remain in full force and effect. No term of these Terms shall be deemed a further or continuing waiver of such or any other term. In addition, College Essentials ’s failure to enforce any term of these Terms shall not be deemed as a waiver of such term or otherwise affect College Essentials ’s ability to enforce such terms at any point in the future.

Privacy

College Essentials is committed to protecting your privacy and ensuring your site's use is entirely secure. This Privacy Policy covers College Essential’s treatment of the Personally Identifiable Information (defined below) we collect when you use the Site. This Privacy Policy is incorporated into our Terms of Use and governs your Site use. By using the Site, you accept the terms of this Privacy Policy. Collection of Information. College Essentials may use the standard cookie feature of major browser applications and third-party providers, including Google Analytics features, or employ internally developed cookies and tracking codes that allow College Essentials to store a small piece of data on a visitor's computer or any other device a visitor uses to access the Site, about his or her visit to the Site. Similar technologies may also be used to analyze trends, administer the Site, track users’ movements around the Site, and gather aggregate demographic information about our user base. These methods and practices are not linked to any Personally Identifiable Information on the Site. You can remove persistent cookies by following the directions in your Internet browser’s “help” directory. If you reject cookies, you may still use the Site, but your ability to use some areas of the Site may be limited.

Use and Sharing of Information

We may collect the information of third-party individuals as necessary, such as by asking our customers to indicate individuals given power-of-attorney authority. College Essentials uses this information to administer its services to our customers, does not use it for any other reason, and holds such information strictly confidential.

We will use Personally Identifiable Information to provide you with the products and services you request, such as completing legal forms, completing transactions, and/or communicating back to you. Credit card numbers are used only for payment processing and not for any other purpose.

We may also use Personally Identifiable Information in a manner that does not identify you specifically nor allow you to be contacted but does identify specific criteria about you and our Site's users in the aggregate and in general (for example, we may inform third parties about the number of users; the number of unique visitors; and the pages most frequently browsed).

We display personal testimonials of satisfied customers. These testimonials will not be displayed without your explicit consent. If you have given us such consent but wish to update or delete your testimonial, you can contact us at help@mycollegedocs.com

We will not sell, trade, or rent your name or Personally Identifiable Information to anyone else. College Essentials will not release your Personally Identifiable Information to government authorities unless required by law.

Advertising. We advertise with third-party ad networks, such as Google Adwords. These ad networks use cookies and other web technology to collect non-personally identifiable information about your activities on this and other Internet sites to provide targeted advertising based on your interests. We do not have access to or control over these technologies. We do not tie the information gathered to you or your Personally Identifiable Information. If you wish not to have this information used to serve your targeted ads, you may opt out by undertaking the appropriate process outlined by the ad providers.

Fraud. Email and online fraud are continuing concerns for virtually all businesses operating online. Be aware that, from time to time, fraudulent emails may be circulated to you that appear to be from College Essentials but which are sent by fraudsters trying to steal your login credentials.

Opting Out. We will occasionally send you promotional emails and newsletters if you have opted to receive such emails. You can opt out of these communications by using the "Unsubscribe" link and following the unsubscribe instructions or by emailing us at help@mycollegedocs.com
